Photographs and videos are classified as ‘personal information’ under the Privacy and Data Protection Act 2014.
In accordance with the Safe Use of Digital Technologies and Online Environments Policy, only service-issued electronic devices to used when taking images or videos of children while providing education and care. This means no devices that take photos are allowed in the kinder room at kinder.
Staff at the service may take photographs/videos of children as part of the program. These may be displayed at the service, or distributed via the OWNA app, which is the communication tool used to communicate with parents on a regular basis. Photos may be distributed to all parents within your group, or sent only to the parent of the child in the photo. Some staff may use learning journals in which photographs are included. You can download photos from OWNA to keep. A log is kept in OWNA showing who is downloading images. OCK request parents only download photos of their own child.
When the photographs/videos are no longer being used, the service will destroy them if they are no longer required, or otherwise store them securely at the service as per Regulation 177.
Photographs/videos for use in newspapers, OCK website/social media platforms and other external publications
The permission of parent/guardian of children will, on every occasion, be obtained prior to a child’s photograph being taken to appear in any newspaper/media or external publication, including the service’s newsletter, publications and website/social media platforms.
Photographs taken by a photographer engaged by the service
A photographer may be engaged by the service to take individual and/or group photographs of children. Information will be provided in written form to parent/guardian prior to the event, and will include the date and the photographer’s details.
Access to photographs/videos
Access to any photographs or videos, like other personal information, is set out in the service’s Privacy and Confidentiality Policy, which is displayed at the service and available on request.
Confirmation of consent
When you enrol at OCK, the OWNA enrolment form asks you for your consent in relation to photo’s/video footage. We always use this consent when reviewing and distributing photos.
If you wish to change your consent options at any time, you can do so in the app or by emailing OCK. We will update your consent and save your email to your child’s record.
